This week's guest is Sam Brylawski, the co-author of The State of Recorded Sound Preservation in the United States. This congressionally-mandated study is ominously subtitled "A National Legacy at Risk in the Digital Age"...But wait, wasn't the digital revolution supposed to solve this problem? The former head of Library of Congress' Recorded Sound Section will outline some of the hurdles that stand in the way of our utopian digital archive.

On November 14th, the Illegal Art label dropped All Day, the first release in over two years by the world's most renowned mashup artist Girl Talk. The free, purportedly "Creative Commons" release is a pop culture kaleidoscope with 372 overlapping samples of songs by the likes of The Rolling Stones, Prince, Nirvana and Beyoncé. Girl Talk claims this is a transformative fair use, and we'd like to believe him, but then again, it was released on a label called "Illegal Art". So why hasn't Girl Talk been sued? We'll address this question and more with law professor Peter DiCola, an expert on copyright law’s regime for digital sampling, and co-author (with Kembrew McLeod) of the forthcoming book Creative License: Digital Sampling, Culture, and the Law. |

Thursday, December 16th, 9am - Noon: Paul Boutin: "The Age of Music Piracy Is Officially Over"

Will 2010 go down as the year people quit downloading music illegally? Guest Paul Boutin writes about social networks and digital media for the New York Times, reviews books for the Wall Street Journal, and his latest Wired Magazine essay declared that "The age of stealing music via the Internet is officially over". Boutin describes how technological innovations have made the prospect of paying for digital music way more appealing than it was in Napster's heyday. But even as the hand of law came down this year against popular filesharing websites like Limewire and the Pirate Bay, Pirate Party leader Rick Falkvinge made quite the opposite declaration: "File sharing is increasing every day and the only thing this means is that more and more people will try to hide what they are doing on the internet." We'll discuss where things stand with music piracy as 2010 comes to a close.

The first episode features Eric Steuer from Creative Commons (also of Wired Magazine and the electronic/hip-hop group Meanest Man Contest). We talk about the licenses that facilitate sharing, openness and in
novation everywhere from The White House to Al Jazeera to the Free Music Archive to this very podcast. We also talk about CBC Radio's recent decision to stop using Creative Commons music -- once a prominent feature of programs like Spark -- due to the usage restrictions of CC's more popular noncommercial licenses. To gain a better understanding of the situation, we crack open CC's recent Study of How the Online Population Understands “Noncommercial Use” and discuss how this might play into the future of Creative Commons. And speaking of The Future, the nonprofit organization is currently in the midst of their Superhero campaign, so we talk about some of the exciting things on the horizon.
